背景资料
建设单位将一风力发电厂建设工程项目的土建工程和设备安装工程施工任务分别发包给某土建施工单位和某设备安装单位。经总监理工程师审核批准，土建施工单位又将桩基础施工分包给一专业基础工程公司。建设单位与土建施工单位和设备安装单位分别签订了施工合同和设备安装合同。在工程延期方面，合同中约定，业主违约一天应补偿承包方5000元人民币，承包方违约一天应罚款5000元人民币。该工程所用的桩是钢筋混凝土预制桩，共计1200根。预制桩由建设单位供应。按施工总进度计划的安排，规定桩基础施工应从5月10日开工至5月20日完工。但在施工过程中，由于建设单位供应预制桩不及时，使桩基础施工在5月12日才开工；5月13日至5月18日基础工程公司的打桩设备出现故障不能施工；5月19日至5月22日又出现了属于不可抗力的恶劣天气无法施工。
