1991年7月，中国丰和贸易公司与美国威克特贸易有限公司签订了一项出口货物的合同，合同中，双方约定货物的装船日期为1991年11月，以信用证方式结算货款。合同签订后，中国丰和贸易公司委托我国宏盛海上运输公司运送货物到目的港美国纽约。但是，由于丰和贸易公司没有能够很好地组织货源，直到1992年2月才将货物全部备妥，于1992年2月15日装船。中国丰和贸易公司为了能够如期结汇取得货款，要求宏盛海上运输公司按1991年11月的日期签发提单，并凭借提单和其他单据向银行办理了议付手续，收清了全部货款。但是，当货物运抵纽约港时，美国收货人威克特贸易有限公司对装船日期发生了怀疑，威克特公司遂要求查阅航海日志，运输公司的船方被迫交出航海日表。威克特公司在审查航海日志之后，发现了该批货物真正的装船日期是1992年2月15日，比合同约定的装船日期要迟延达三个多月，于是，威克特公司向当地法院起诉，控告我国丰和贸易公司和宏盛海上
运输公司串谋伪造提单，进行欺诈，即违背了双方合同约定，也违反法律规定，要求法院扣留该宏盛运输公司的运货船只。
美国当地法院受理了威克特贸易公司的起诉，并扣留了该运货船舶。在审法院的审理过程中，丰和公司承认了其违约行为，宏盛公司亦意识到其失理之处，遂经多方努力，争取庭外和解，最后，我方终于在美国威克特公司达成了协议，由丰和公司和宏盛公司支付美方威克特公司赔偿金，威克特公司方撤销了起诉。
